On this page The service Eligibility Subscriptions Disclaimers Contact

These Terms of Service ("Terms") govern your use of the Actually Mail mobile application (the "App"), provided by Nirvantric ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Actually Mail is a local-first email client for iOS. It connects, directly from your device, to email accounts you choose to add (Gmail, Microsoft 365/Outlook/Exchange, or any IMAP/SMTP-compatible provider such as Yahoo, iCloud, or AOL) so you can read, organize, and send mail through those accounts. The App also offers optional features such as on-device AI summaries, an optional mood check-in via Apple HealthKit, Face ID app-lock, and a Pro subscription unlocking additional features via Apple's StoreKit.

We do not operate a mail server, and we do not act as your email provider. Your email account remains with, and is governed by, whichever provider you connect (Google, Microsoft, Yahoo, Apple, or another provider).

2. Eligibility

You must be at least 13 years old to use the App. You must own, or have proper authorization to access, any email account you connect to the App. You are responsible for complying with the terms of service of each mail provider you connect.

3. Your Account and Subscriptions

  • Connecting a mail account requires signing in through that provider's own authentication flow (e.g., Google Sign-In, Microsoft sign-in) or, for IMAP/SMTP accounts, an app-specific password you generate with your provider.
  • Pro subscription purchases are billed and managed entirely through your Apple ID / the App Store, subject to Apple's own terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your device's Settings app under your Apple ID. Refunds are handled by Apple according to Apple's refund policies — we do not process payments or issue refunds directly.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose, or to send spam, malware, or fraudulent content;
  • Attempt to reverse engineer, decompile, or circumvent the App's security or licensing mechanisms, except to the extent expressly permitted by applicable law;
  • Use the App in a way that violates the terms of service of any connected mail provider (Google, Microsoft, or otherwise);
  • Interfere with or disrupt the integrity or performance of the App.

5. Third-Party Services

The App integrates with third-party mail providers and platform services (including but not limited to Google, Microsoft, Apple HealthKit, and Apple StoreKit). These third parties operate independently of us:

  • We do not control, and are not responsible for, the availability, accuracy, security, or content of any third-party mail provider or service.
  • Your use of any connected provider is governed by that provider's own terms of service and privacy policy, in addition to these Terms.
  • Changes made by a third-party provider (e.g., API changes, outages, policy changes) may affect the App's functionality, and we are not liable for such changes.

6. Intellectual Property

The App, including its design, code, and branding, is owned by Nirvantric and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your own devices for personal, non-commercial use, subject to these Terms.

You retain all rights to your own email content and data. We claim no ownership over the content of your messages, contacts, or other personal data accessed through the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, PARTICULARLY GIVEN THE APP'S RELIANCE ON THIRD-PARTY MAIL PROVIDERS OUTSIDE OUR CONTROL.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIRVANTRIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, MESSAGES, OR PROFITS, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

[This section is boilerplate and should be reviewed by an attorney for enforceability in your specific jurisdiction(s).]

9. Indemnification

You agree to indemnify and hold Nirvantric harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the App.

10. Termination

You may stop using the App at any time by disconnecting your accounts and/or deleting the App from your device. We may suspend or terminate your access to the App if you violate these Terms. Provisions that by their nature should survive termination (including Sections 6–9) will survive.

11. Changes to the App or Terms

We may modify or discontinue features of the App, or update these Terms, at any time. We will update the "Last updated" date above when the Terms change. Continued use of the App after a change constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles.
